Biden and his admin tried to twist the power to forgive some student debt in specific circumstances into a general power to do a massive generic debt transfer from the students who took it on to other Americans. All without Congressional input. This was bad policy and exceeded his authority. The courts were right to step in and say he couldn’t do it. The partisans on the left reacted by attacking and trying to delegitimize the courts, but that didn’t change the reality. Now the Trump admin has tried to twist the power to impose tariffs under specific circumstances into a general power to unilaterally impose ever-changing global tariffs and thus applying a massive tax on American consumers. All without Congressional authority. This is bad policy and exceeds the executive’s statutory authority. The courts are right to step in. The partisans that react by attacking the courts aren’t doing anything different than throwing a tantrum because their guy doesn’t have unlimited powers. We have checks for a reason. I say all of this as someone who also thinks that lots of Judges have far exceeded their authority to try to interfere with the Trump administration’s policies on immigration enforcement, where the executive has far more power. Those judges need to be reined in by SCOTUS. But that doesn’t mean every ruling against the admin is wrong.
