The elements of kidnap are as follows: 1) abduction of the victim, 2) using force, fear, or intimidation, 3) without consent. If these elements are satisfied, the defendant is guilty of the crime of kidnapping. The following is not a legal defense to kidnap: “the victim was given food.”
