One sub-issue is whether the Court's findings in its 2024 Advisory Opinion on the legality of the occupation can "be used as a stepping stone" to get to liability in contentious proceedings even where to do so would require ruling on the conduct of an "indispensable third party" (here, Israel). Germany strongly objects to this approach.
